  18. 85% State reservation in medical seats in NEET against Constitution
    Sir, DR. A. K Maity Calcutta,WB.
I want to draw your kind attention about few points for National Eligibility Cum Entrance Test (NEET) in Undergraduate Medical Entrance throughout India.
    1. In NEET – Undergraduate Medical Entrance there is a common syllabus, single exam, one result. Medical Council of India (MCI) has agreed to reserve 85% seats as State Quota when the demand raised by different stated Govts in MCI meeting.
In West Bengal, Tamil Nadu and some other states there were District-wise reservation for admission to a medical college which was struck down by Supreme Court on the ground that the object of the selection of candidate for the admission is to select the best possible talent from the entire state, having regards to efficiency required for medical profession. It is against Article 14 of Indian Constitution.
(Supreme Court Case : (i) Minor P. Rajendran vs State Of Madras & Others on 17 January, 1968. (ii) Dr. Pradeep Jain and Others Vs Union of India and Others ,Writ Petitions Nos. 6091, 8882-83, 9219 and 9820 of 1983, Civil Appeal No. 6392 of 1983 , EQUIVALENT CITATION – 1984-(001)-Scale-0894-SC 1984-(002)-LLJ-0481-SC 1984-(003)-SCC-0654-SC 1984-(003)-SCR-0942-SC 1984-AIR-1420-SC CORAM P. N. Bhagwati A. P. Sen Ranganath Misra DATE OF JUDGMENT – 22.06.1984 )
So State-wise reservation of 85% NEET – UG medical seats for admission in a medical college through NEET is against Article 14 of Constitution.
When there will be no state-wise reservation, in educationally backward states majority of seats in medical will be filled up by the brilliant students of other states. Provincialism will create a new problem. There will be a problem of law and order.
Article 14 in The Constitution Of India 1949
[ Equality before law The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth]

    2. The recent published (dated 03/11/2011) Final Syllabus by Medical Council of India for National Eligibility-cum-Entrance Test (NEET) for admission to MBBS courses across the country is not a uniform syllabus for 11th and 12th standard classes of all existing 10 + 2 Boards all over India The published syllabus for NEET in medical matches more or less 95% with CBSE 10 + 2 syllabus ; 60 – 80% matches with the others 10 + 2 boards of different states. As a result, CBSE Board students will get extra advantage in NEET-2012. It is bad-in-law.
Sudden implementation of this class 11th and class 12th syllabus (i.e. NEET syllabus) is not a right decision. Usually 2 years minimum is required for implementation a new syllabus. Only 150 days remain for preparation of medical Entrance(s) – 2012. Higher Secondary /Equivalent Board students are going to appear/already appeared their Test exams for Final Board Exams. NEET -2012 is just after final exam. How it is possible to cover new syllabus?

    3. Since most of the CBSE schools are in metropolitan cities, what will be the dream / fate of rural students who are studying with state board syllabus. More metropolitan students will occupy the maximum seats in different medical colleges. Rural health system will go in danger due to lack of doctor.

  23. atishay bansal says:

    is aiims included in neet????
